What it means

Penalty levels: first failure €100; second €200; third €400; fourth and each subsequent failure within 24 months €500. Paying within 30 days extinguishes criminal liability connected with that failure. Failures are also entered into the business risk-assessment system and increase its risk score, potentially increasing audit, inspection or investigation likelihood.

Affects: Companies & SMEs.

Who qualifies and what is excluded

  • €500 level applies to the fourth and later failures within 24 months.
  • Criminal liability connected with the penalised failure is extinguished if penalty is paid within 30 days.
  • Exception: The speech refers to the failure covered by the penalty; it does not state blanket immunity for other offences.
